Terms of Service for 1NBOX

Effective Date: October 7, 2025

These Terms of Service (“Terms”) govern your access to and use of the 1NBOX platform and related services (“Services”), owned and operated by ACE CODERS (Pty) Ltd (Registration No. 2025/784991/07), a private company incorporated in South Africa (“we”, “our”, “us”). By accessing or using 1NBOX, you agree to be bound by these Terms.

1. Overview of 1NBOX

1NBOX provides a unified messaging platform that integrates multiple communication channels such as WhatsApp, Messenger, Instagram, Gmail, and Email. It also includes AI-assisted tools for automated replies and business data-driven insights.

2. Acceptance of Terms

By accessing or using the 1NBOX Services, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and any additional guidelines or policies referenced herein. If you do not agree, you may not use the Services.

3. Eligibility

You must be at least 18 years old or have legal capacity to enter into binding agreements under South African law. By using 1NBOX, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to immediately notify us of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

5. Acceptable Use

You agree not to use 1NBOX to:

• Send unsolicited or spam messages.
• Transmit unlawful, defamatory, abusive, or fraudulent content.
• Interfere with the operation of the platform or attempt unauthorized access to any system or data.
• Use the AI tools for generating misleading, harmful, or illegal content.

6. Integration and External Services

1NBOX may integrate with third-party services (e.g., WhatsApp, Meta Messenger, Instagram, Gmail, IMAP/POP Mail). You acknowledge that use of these integrations is subject to the terms and policies of those respective platforms. We are not responsible for third-party systems, downtime, or changes to their APIs.

Our integration with WhatsApp and Meta platforms complies with the WhatsApp Business Platform Policy and the Meta Developer Terms.

7. Data and Privacy

Our collection and processing of personal information are governed by the 1NBOX Privacy Policy and in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

• You retain ownership of your messages, data, and business content shared through 1NBOX.
• You grant ACE CODERS (Pty) Ltd a limited license to process, transmit, and store this data solely for providing and improving the Services.
• We comply with the POPIA, Electronic Communications and Transactions Act (ECTA), and Consumer Protection Act (CPA) in all data processing and commercial practices.

8. Subscription and Payments

• Some features of 1NBOX may require a paid subscription.
• All payments are processed through secure third-party payment gateways.
• Subscription fees are non-refundable except as required by South African consumer law.
• We reserve the right to modify pricing with reasonable prior notice to existing subscribers.

9. Intellectual Property

All content, code, trademarks, and materials on 1NBOX are owned by ACE CODERS (Pty) Ltd or its licensors. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

10. AI Features

1NBOX includes AI-powered features for auto-replies and business insight generation. You acknowledge that:

• AI responses are generated automatically based on available data and may not always be accurate.
• You are responsible for reviewing and approving AI-generated content before relying on or sending it.
• We do not accept liability for business decisions made based on AI outputs.

11. Limitation of Liability

• 1NBOX and ACE CODERS (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from use or inability to use the Services.
• We make no guarantees that the platform will be uninterrupted, secure, or error-free.
• Our total liability for any claim shall not exceed the amount paid (if any) by you to use 1NBOX during the previous 12 months.

12. Termination

• You may terminate your account at any time through the platform or by contacting us at support@1nbox.co.za.
• We may suspend or terminate access if you breach these Terms, misuse the platform, or act unlawfully.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Amendments

We may revise these Terms periodically. Continued use of 1NBOX after updates are posted constitutes acceptance of the revised Terms.
